Migration Update : 10 March 2023

1. Permanent residence pathway for Temporary Skill Shortage (TSS) subclass 482 visa holders with an occupation on the Regional Occupation

Starting from 1 July 2022, changes have been made to improve the permanent residency pathway for skilled migrant workers who decided to remain in Australia during the pandemic.

Under the Temporary Residence Transition (TRT) stream of the Employer Nomination Scheme (ENS) subclass 186 visa, Temporary Skill Shortage (TSS) subclass 482 visa holders who have stayed in Australia for at least one year between 1 February 2020 and 14 December 2021 can apply for permanent residency. However, applicants must satisfy all other nomination and visa requirements for the TRT stream of the ENS visa.

This pathway is also open to Medium-term stream TSS visa holders with an occupation listed on the Regional Occupation List, in addition to Short-term stream TSS visa holders. The pathway is valid for two years from 1 July 2022.

2. GSM Skills assessment obtained within 60 days invitation period will be accepted.

Delegates of the Minister will now accept a suitable skills assessment obtained within the 60-day invitation period for an applicant’s nominated skilled occupation. It is essential to declare that you possess a suitable skills assessment at the time of invitation for your application to be valid.

3. For all AHPRA regulated occupations, provisional or limited registration under subclass 186 is now accepted.

4. The Professional Year program is now valid for four years from the date of completion if completed in Australia in the four years preceding the invitation to apply for a visa.
